Terms & Conditions

Effective Date

This website is operated by Luxo Floors. Throughout the site, the terms “we,” “us,” and “our” refer to Luxo Floors. Luxo Floors offers this website, including all information, tools, and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.

1. TERMS

a. An order placed by a purchaser or customer (“CUSTOMER”) is subject to the following conditions of sale unless otherwise expressly agreed to in writing by Luxo Floors.

b. These terms and conditions supersede any terms and/or conditions set forth in any purchase order or other written document by the ordering party.

2. TRADING TERMS

Terms are strictly payment before delivery unless:

a. Prior credit arrangements have been made in accordance with Luxo Floors’ Credit Policy; or

b. The enforcement of prepayment would contradict any applicable laws, in which case the amount payable prior to installation shall be as per relevant legislation.

c. Prices quoted on invoices supersede all previous prices and may be subject to change without notice. The final price will be determined on the date of order dispatch.

d. Sizes and weights provided are approximate due to natural variations in materials. Luxo Floors will not be held responsible for such variations if they fall within accepted industry standards.

e. Any promotional or display materials provided by Luxo Floors remain our property and must be returned upon request.

3. ORDERS

a. All orders must be paid in full for the value of the invoice.

4. SUPPLY OF PRODUCTS

a. It is the sole responsibility of the customer to verify their order at the time of purchase or delivery, including but not limited to dimensions, colours, shade variations, and quantities.

b. Due to natural variations in products like ceramics or natural stone, differences in shade, size, or quality between shipments are expected.

c. All products should be checked for size, colour, and quality before installation. Luxo Floors takes no responsibility once the products have been installed.

d. Measurements and quantities should be confirmed with your installer prior to ordering. We are not responsible for discrepancies in the ordered quantity.

e. All products should be installed as per the manufacturer’s guidelines and industry standards.

f. Luxo Floors accepts no liability for damage resulting from inappropriate cleaning methods or non-recommended procedures.

5. GOODS IN STORAGE

a. Goods held in storage on behalf of the customer will incur a daily fee after 14 days, calculated at $3 per pallet per day.

6. TITLE OF GOODS

a. Ownership of goods transfers to the customer only upon full payment of the invoice and any other outstanding amounts.

b. The customer is responsible for any costs incurred by Luxo Floors, including legal fees, in the event of payment disputes or debt recovery.

7. WARRANTY

Luxo Floors is not responsible for indirect, special, or consequential damages, except as follows:

a. Some goods come with a manufacturer’s warranty. Details will be provided with your product.

b. Manufacturer warranties do not cover labour or delivery costs.

c. The warranty period begins at the time of delivery or pick-up.

8. INDEMNITY

a. All other warranties, express or implied, including those relating to merchantability or fitness for a specific purpose, are excluded to the extent permitted by law.

b. Luxo Floors’ liability is limited to one of the following options, at our discretion:

i. Replacement of goods;

ii. Repair of goods;

iii. Payment of the cost to replace or repair goods.

c. Luxo Floors is not liable for claims beyond the value of the product as listed on the invoice.

9. DELIVERIES

a. Luxo Floors will make reasonable efforts to deliver goods on the specified date during business hours. However, we are not liable for delays due to circumstances beyond our control.

b. Claims for damaged goods or discrepancies must be reported within two days of delivery, with photographic evidence provided.

10. CANCELLATIONS, REFUNDS, AND CREDITS

We do not accept returns unless required by law. Refunds or credits are subject to the following conditions:

a. No refunds or credits for change of mind.

b. Original sales invoices must be provided.

c. Products must be in a saleable condition.

d. Custom-made products cannot be cancelled or returned.

11. SEVERABILITY

If any part of these terms is deemed invalid, the remaining provisions shall remain in full force and effect.

12. GOVERNING LAW

This Agreement is governed by and construed according to the laws of Queensland.

13. ONLINE PURCHASES

By selecting delivery, you agree to accept the product within 2-14 business days. Failed delivery attempts due to unavailability will incur additional fees.

Promotions are subject to change at the discretion of Luxo Floors. Please review the specific terms of your offer.
